C. Gerichtsentscheide 3061

3. Verfahren 3.1 Zivilprozess 3061 Verm ittlungsverfahren. Bei Aberkennungsprozessen mit einem Streit­wert unter Fr. 5000 - findet keine Vermittlung statt (Art. 6 Ziff.2, Art. 8 Ziff. 2 ZPO). Der Wortlaut von Art. 6 ZPO (Verfahren ohne Vermittlung) ist eindeutig. Ein Vermittlungsverfahren findet nicht statt: «2. bei Zuständigkeit des Einzelrichters, ausgenommen die Fälle von Art. 7 Ziff. 2 und Art. 8 Ziff. 2 ZPO.» Es handelt sich hier um eine abschliessende Aufzählung der Ausnah­men. Hätte der Gesetzgeber etwas anderes gewollt, so hätte er hier auch die Aberkennungsklage bis Fr. 5000 - aufführen müssen. Sollte es sich tat­sächlich um eine «Lücke» handeln, so könnte diese nur durch den Gesetz­geber geschlossen werden. Für eine richterliche Interpretation im Sinne von Art. 1 Abs. 2 ZGB ist hier kein Raum. Dass das Gesetz für Aberkennungsklagen unter Fr. 5000 - keine Ver­mittlung vorsieht, ist auch sachlich begründet. Die Vermittlung in Forde­rungsprozessen vor dem Einzelrichter (Art. 7 Ziff. 2 und Art. 8 Ziff. 2 ZPO) wurde im endgültigen Gesetzestext festgelegt, weil die Vermittler nach­weisbar einen erheblichen Prozentsatz der Forderungsstreitigkeiten ver­mitteln können, was für die relativ seltenen Aberkennungsklagen nicht zu­trifft. Hat eine Streitsache schon vor dem Rechtsöffnungsrichter (ohne Vermittler) nicht beigelegt werden können, so ist umso weniger einzuse­hen, wie dies im nachfolgenden Aberkennungsprozess der Fall sein sollte.
