Ferner ist nach A rt.114 EG zum ZGB1 2 eine Grenzregulierung auch ohne Quartierplanverfahren möglich, wenn ein Grundstück sonst nicht überbaut oder bewirtschaftet werden kann. Die Baulandumlegung als planungsrechtliches Instrument ist eine öffentlich-rechtliche Eigentumsbeschränkung (vgl. BGE 95 I 372), wofür eine gesetzliche Grundlage bestehen muss. Diese ist hier, wie ausgeführt, in einem formellen Gesetz vorhanden. Für die Baulandumlegung ist sodann begriffswesentlich, dass das Eigentum sowohl in bezug auf den Wert, die Art der Nutzung und die Grösse des Grundstückes erhalten bleibt (L. Schürmann, Bau- und Planungsrecht, 2.erw. Auflage, S. 85). Die Landumlegung basiert somit auf dem Prinzip des Realersatzes (BGE 9 5 1372). Sie ist deshalb keine formelle Enteignung, sondern mit ihr lediglich sachverwandt. Aus dieser Sachver- wandtschaft ergibt sich nach bundesgerichtlicher Rechtsprechung, dass ein Eigentümer die Garantien des Expropriationsverfahrens anrufen kann, wenn das Umlegungsverfahren seinen berechtigten Ersatzansprüchen nicht genügen kann (BGE 100 lb 84). Das wird etwa der Fall sein, wenn ein Gebäude oderein Quellenrecht von der Umlegung erfasst wird. In solchen Fällen ist Realersatz wohl regelmässig unmöglich. RRB 4.12.1984 1 Heute: vgl.
