The Regierungsrat of Aargau ruled on a supervisory complaint against the cantonal notarial commission. It clarified the minimum content of the authority’s response under § 38 paras. 1 and 2 VRPG: the reply must indicate whether the complaint was considered, how the authority reacted, and how it assessed the facts. It may additionally state whether supervisory measures are intended to restore proper administration, but this is optional.

Key legal question

What information a response to a supervisory complaint must provide under § 38 paras. 1 and 2 VRPG.

Extracted holding

The reply must state whether the complaint was taken up, how the supervisory authority reacted, how it assessed the facts, and optionally whether it intends to take supervisory measures to restore proper administration.

Extracted reasoning

A supervisory response is not merely an acknowledgment; it must give the complainant meaningful information about the handling and assessment of the complaint. Optional notice of planned measures may be added, but is not mandatory.
