28 Obergericht 2009 insofern Rechnung getragen, als der wirtschaftlichen Selbständigkeit (Eigenversorgungskapazität) grösseres Gewicht zugemessen wird. 2 Art. 176 ZGB Prozesserledigung im Eheschutzverfahren aufgrund einer von den Parteien getroffenen Vereinbarung. Aus den Erwägungen Die von der Vorinstanz gewählte Verfahrenserledigung in den von den Parteien durch Vergleich erledigten Punkten (darunter Unterhalt) ist problematisch. Anders als im Scheidungsrecht bedürfen in einem Eheschutzverfahren geschlossene Vereinbarungen keiner richterlichen Genehmigung. Folglich hat der Eheschutzrichter dem kantonalen Prozessrecht entsprechend das Verfahren insoweit, als es um der Parteidisposition unterliegende Ansprüche geht (so der Anspruch auf persönlichen Unterhalt eines Ehegatten), als durch Vergleich erledigt von der Kontrolle abzuschreiben, was in einem ein Urteilssurrogat darstellenden Abschreibungsentscheid geschieht (während die Genehmigung einer Konvention in Urteilsform erfolgt).
