November 2001 schloss der Erblasser mit Frau R. ebenfalls einen Erbvertrag ab. In Ziffer III.1. des Vertrages hoben die Parteien sämtliche, allfällig errichteten Verfügungen von Todes wegen auf und setzten in Ziffer IV als Willensvollstrecker je einzeln und letztwillig den Beschwerdeführer ein. Der Beschwerdeführer rügt die Einsetzung von L. in der Erbgangsurkunde. Aus den Erwägungen 3. a) Im Erbfall ist dem Willensvollstrecker seine Ernennung von Amtes wegen mitzuteilen. Dieser hat sich binnen 14 Tagen, von der Mitteilung an gerechnet, über die Annahme des Auftrages zu erklären, wobei sein Stillschweigen als Annahme gilt (Art. 517 Abs. 2 ZGB).
