Omnilex summary

The court upheld removal detention. It held that detention ends for lack of travel fitness only once an adequate assessment establishes a longer-term inability to travel. It also ruled that a detainee cannot rely on having remained available to the authorities when, because replacement travel documents were lacking, he could not reasonably expect removal to be carried out.

Omnilex headnote

Removal detention; termination only if clarified that the person is unfit to travel for a longer period. The detainee’s duty to cooperate is not converted into a ground for release merely because he remained at the authorities’ disposal; if deportation was not realistically imminent due to missing replacement travel documents, prior availability cannot be invoked to defeat detention (consid. 2.3, 3.2).

Key legal question

When does a ground for ending removal detention exist because the detainee is not fit to travel?

Extracted holding

A ground for ending detention exists only after clarification shows that the detainee will be unfit to travel for a longer period.

Extracted reasoning

The court required a confirmed, longer-term lack of travel fitness; mere doubts or temporary incapacity are not enough to terminate detention.

Key legal question

Can the detainee rely on having always been available to the authorities if removal is unlikely due to missing replacement travel documents?

Extracted holding

No. If the person could not reasonably expect deportation because replacement documents were missing, he cannot invoke continuous availability to the authorities as a basis to challenge detention.

Extracted reasoning

The court held that the relevant point is the realistic enforceability of removal, not merely prior willingness to cooperate.
