Begründung:

[1] Das Rekursgericht wies den Rekurs des Verpflichteten gegen den Beschluss des Erstgerichts, mit dem der Antrag des Betreibenden nach § 249a Abs 1 Z 4 EO bewilligt wurde, zurück.

[2] Gegen die Zurückweisung seines Rekurses richtet sich der „außerordentliche Revisionsrekurs“ des Verpflichteten.

[3] Die Aktenvorlage entspricht nicht der Rechtslage.

[4] Nach ständiger Rechtsprechung ist die Zurückweisung eines Rekurses gegen einen Beschluss des Erstgerichts durch die zweite Instanz grundsätzlich nur mit Revisionsrekurs nach den Voraussetzungen gemäß § 528 ZPO anfechtbar (RS0044501 [T18]).

[5] Wenn der Entscheidungsgegenstand der zweiten Instanz – wie hier – an Geld oder Geldeswert zwar 5.000 EUR, nicht aber 30.000 EUR übersteigt und das Rekursgericht – wie hier – den ordentlichen Revisionsrekurs für nicht zulässig erklärt hat, ist der Revisionsrekurs gemäß § 528 Abs 2 Z 1a ZPO (hier iVm § 78 EO) – außer im Fall des § 528 Abs 2a ZPO – jedenfalls unzulässig. In einem solchen Fall kann eine Partei nur nach § 528 Abs 2a iVm § 508 ZPO den – beim Erstgericht einzubringenden und mit dem ordentlichen Rechtsmittel zu verbindenden – Antrag an das Rekursgericht stellen, seinen Zulässigkeitsausspruch dahin abzuändern, dass der ordentliche Revisionsrekurs doch für zulässig erklärt werde. Diese Vorgangsweise ist auch dann einzuhalten, wenn das Rechtsmittel als „außerordentliches“ Rechtsmittel bezeichnet wurde (vgl RS0109623).

[6] Das Erstgericht hat daher den Rechtsmittelschriftsatz des Verpflichteten dem Gericht zweiter Instanz vorzulegen, das über den Antrag auf Abänderung des Zulässigkeitsausspruchs, gegebenenfalls nach einer von ihm für erforderlich gehaltenen Verbesserung, zu entscheiden hat. Ob und inwieweit das Rechtsmittel einer Verbesserung bedarf, bleibt der Beurteilung der Vorinstanzen überlassen (vgl RS0109623 [T4, T5, T8]; RS0109501 [T12]; RS0109620 [T2]).
