Spruch

1. Das Verfahren wird insoweit, als beantragt wurde, §12 Abs3 des Wertpapieraufsichtsgesetzes, BGBl. 753/1996, aufzuheben, eingestellt.

2. Im Übrigen, also hinsichtlich §101 des Telekommunikationsgesetzes 1997 idF BGBl. I 188/1999 und §104 Abs3 Z24 leg.cit. idF BGBl. I 26/2000, wird der Antrag auf Aufhebung abgewiesen.
