Spruch

I. Die Klage wird zurückgewiesen.

II. Die klagende Partei ist schuldig, dem Bund die mit € 46.362,60 bestimmten Prozesskosten zu Handen der Finanzprokuratur binnen vierzehn Tagen bei sonstiger Exekution zu ersetzen.
