  1. Where the following persons seriously violate the provisions of the financial market acts, the implementing provisions or in-house directives, FINMA may prohibit such persons from trading in financial instruments or acting as a client adviser for a fixed period, or permanently in the case of repeated offences:
    1. employees of a supervised entity responsible for trading in financial instruments;
    2. employees of a supervised entity acting as client advisers.
  2. If the prohibited activity also covers an activity in an area under the supervision of another supervisory authority, this authority is to be consulted and informed of the decision.

N1.Tätigkeitsverbot nach Art. 35a aBEHG

Die Rechtsprechung und Literatur ziehen die gleichen Erwägungen heran wie zuvor bei Art. 35a aBEHG; das Tätigkeitsverbot ist heute in Art. 33a FINMAG geregelt.

Die gleichen Überlegungen gelten für das Tätigkeitsverbot : Nach dem hier noch anwendbaren Art. 35a aBEHG (Fassung vom 22. Juni 2007, in Kraft seit 1. Januar 2009 [AS 2008 5207 5305; BBl 2006 2829]) kann die FINMA Personen - die als verantwortliche Mitarbeiter eines Effektenhändlers den Effektenhandel betreiben und das Börsengesetz, die Ausführungsbestimmungen dazu oder die betriebsinternen Vorschriften grob verletzt haben - die Tätigkeit im Effektenhandel dauernd oder vorübergehend untersagen. Heute ist das Tätigkeitsverbot in Art. 33a FINMAG geregelt (vgl.
