The fund documents of existing collective investment schemes must be adapted to the requirements of Articles 76 paragraph 4 and 106 paragraphs 4 and 5 within two years of the amendment of 31 January 2024 coming into force. The deadline is deemed to have been met on submission of the amended documents to the competent authority.
Article 76 paragraph 5 applies to existing collective investment schemes for the first time for the financial year that begins two years after the new act comes into force.
The requirements of Article 108a must be met in relation to existing collective investment schemes within two years of the amendment of 31 January 2024 coming into force.
