Commentaries: Art. 30a

The Notification Authority may in agreement with the assessment authorities provisionally authorise a biocidal product that contains an active substance that has yet to be approved. The provisional authorisation shall be granted if:
1. ¹ the applicant for the as yet unapproved active substance submits a recommendation from an EU or EFTA member state that the active substance be approved; and
2. the assessment authorities, having regard to Article 11b , take the view that the biocidal product provisionally meets the requirements of Article 11 paragraph 1 letters a–c.
The Notification Authority shall revoke the provisional authorisation if the European Commission decides not to approve the active substance.
