The holder of the licence referred to in Article 34 paragraph 1 must verify that the donor is fit to give blood.
Persons excluded from donating blood shall be those:
whose health could suffer from the extraction of blood;
whose blood may transmit pathogens.
The exclusion criteria must not discriminate against anyone. Insofar as the criteria are linked to the risk behaviour of persons who are willing to donate, they shall relate to individual behaviour and must be scientifically justified.1
The Federal Council shall lay down the requirements relating to the donor’s fitness to give blood, the competence to establish this fitness and the data which must be recorded at the time of the blood donation.
