  1. Businesses and persons that cultivate, produce, process or trade in narcotics require a licence from the Swiss Agency for Therapeutic Products (Swissmedic1). Article 8 is reserved.2
  2. The Federal Council shall regulate the requirements for the grant, expiry or withdrawal of the licence, and its form, content and term of validity.

N1.Bewilligungspflicht für Umgang und Handel mit Mitragynin‑Produkten

Für den Umgang mit Mitragynin‑haltigen Produkten ist eine Bewilligung nach Art. 4 Abs. 1 BetmG erforderlich; dies gilt insbesondere für Handel mit solchen Produkten.

“Die in Kratom enthaltene Substanz Mitragynin ist jeweils im Verzeichnis a der Anhänge 1 und 2 der Betäubungsmittelverzeichnisverordnung aufgeführt. Demzufolge handelt es sich dabei um ein Betäubungsmittel im Sinne von Art. 19 Abs. 1 BetmG (vgl. Art. 2a BetmG in Verbindung mit Art. 1 Abs. 2 lit. a BetmVV- EDI). Der Beschuldigte verfügte während des Deliktszeitraums über keine gültige behördliche Bewilligung für den nachfolgend zu beurteilenden Umgang mit Mit- ragynin-haltigen Produkten (vgl. Art. 4 Abs. 1 BetmG). Er handelte somit unbefugt im Sinne von Art. 19 Abs. 1 BetmG.”
