Art. 69g

  1. The collection agency shall obtain the data on households and their members required for collecting the fee from the following registers:
    1. the register of residents (Art. 2 para. 2 let. a RHA1);
    2. the Ordipro information system of the Federal Department of Foreign Affairs (Art. 2 para. 1 let. c RHA).
  2. It shall obtain the data via the Federal Information and Communication Platform in accordance with Article 10 paragraph 3 RHA.
  3. Cantons and communes shall provide the collection agency with the data from their registers of residents in the required format and with the required regularity for delivery via the Federal Information and Communication Platform in encrypted form.
  4. The collection agency shall pay contributions from the fee revenue to communes and cantons towards the investments specifically required in order to transmit data to the collection agency.
  5. The collection agency may systematically use the OASI number2in terms of Article 50c of the Federal Act of 20 December 19463on Old-Age and Survivors’ Insurance (OASIA):
    1. to fulfil its tasks in connection with collecting the fee;
    2. in the case of queries to communes and cantons related to transmitted data.
  6. The Federal Council shall determine the data that the collection agency may obtain in accordance with paragraph 1. It shall regulate the details with regard to volume and format of the data, the regularity of data deliveries and the contributions to cantons and communes in accordance with paragraph 4.

N1.Zugang der Erhebungsstelle zu Einwohnerdaten

Im Rahmen der Einführung der Haushaltabgabe wurden die vereinheitlichten Einwohnerregister als alleinige Datengrundlage für die Erhebung bestimmt. Die Serafe AG wurde verpflichtet, die Haushaltsdaten aus den Einwohnerregistern zu beschaffen. Der Zugang der Erhebungsstelle zu den Einwohnerregisterdaten ist in Art. 69g RTVG geregelt.

Die für die Haushaltabgabe relevanten Haushaltsdaten stammen aus den Daten der Einwohnerregister der zuständigen Gemeinden oder des Kantons (vgl. Art. 69 RTVG, Art. 67 RTVV und Art. 6 Bst. d RHG). Mit Einführung der Haushaltabgabe entfiel die persönliche Meldepflicht bei der Gebührenerhebungsstelle. Durch die Vereinheitlichung der Einwohnerregister im Rahmen des RHG wurden die Register als alleinige Datengrundlage für die Erhebung der Haushaltabgabe bestimmt. Die Serafe AG wurde verpflichtet, die Haushaltdaten aus den Einwohnerregister zu beschaffen. In jedem Register werden die im betreffenden Kanton beziehungsweise in den betreffenden Gemeinden gemeldeten Personen mittels einer Personen-Identifikatornummer erfasst und jeweils einer bestimmten Gebäude- und einer Wohnungs-Identifikatornummer zugeordnet. Der Zugang der Erhebungsstelle zu den Daten der Einwohnerregister ist in Art. 69g RTVG geregelt (m.w.H. Botschaft vom 29. Mai 2013 zur Änderung des RTVG, BBl 2013 4975, 4999 f.).
