The Federal Office for Customs and Border Security (FOCBS) is authorised to notify the proprietor of a patent that is valid in Switzerland if there is any suspicion that goods that infringe a patent valid in Switzerland are about to be brought into or taken out of the customs territory.
In such cases, the FOCBS is authorised to detain the goods for three working days in order that the person entitled to file an application in accordance with Article 86b can do so.
