Commentaries: Art. 49

Any person who wishes to obtain a patent for an invention must file a patent application with the IPI.
The patent application must contain:
1. a request for the grant of a patent;
2. ¹ a description of the invention and, where a claim is made for a sequence derived from a sequence or partial sequence of a gene, a specific description of the function it performs;
3. one or more patent claims;
4. the drawings to which the description or claims of the patent refer;
5. an abstract.²
