If the mother dies on the day of the birth or during the 14 weeks thereafter, the other parent is entitled to leave of 14 weeks; this leave must be taken on consecutive days from the date of the death.
The other parent is entitled to the leave if the relationship with the child is established on the date of death or during the 14 weeks thereafter.
In the event of the hospitalisation of the new-born child in accordance with Article 329f paragraph 2, leave in accordance with paragraph 1 shall be extended by the duration of the hospitalisation, up to a maximum of eight weeks.
