Action for rescission of the contract of sale may be brought if the object has been destroyed as a result of its defects or by accident.
In such cases the buyer must return only that which remains of the object.
If the object is destroyed through the fault of the buyer or has been sold on or transformed by him, his only claim is for compensation for the decrease in value.
