  1. The bill of exchange may be issued in multiple identical duplicates.
  2. Such duplicates must be given serial numbers within the text on the instrument; otherwise, each duplicate counts as a separate bill of exchange.
  3. Every holder of a bill of exchange may request that multiple duplicates be supplied to him at his own expense, provided the text of the bill of exchange does not stipulate that it was made out as a single copy. To do so, the holder must contact the preceding endorser immediately before him, who in turn must contact his immediately preceding endorser, and so on in sequence back to the drawer. The endorsers are obliged to repeat their endorsements on the newly issued duplicates.

N1.Originalerfordernis und Duplikatwirkung

Zur Ausübung des mit dem Wechsel verbundenen Anspruchs ist das Original erforderlich; ein Duplikat ist nur wirksam, wenn es gemäss Art. 1063 OR ausgestellt ist. Eine Fotokopie ersetzt weder das Original noch ein nach Art. 1063 OR gültiges Duplikat und begründet daher kein Vorlegungs- bzw. Ausübungsverlangen.

“Come rettamente rilevato dal Pretore, la fotocopia di una carta valore non costituisce valido titolo di rigetto provvisorio ai sensi del­l’art. 82 LEF, in quanto per esercitare il diritto incorporato nella carta valore è necessario presentare l’originale del titolo o – per la cambiale unicamente (cfr. art. 1098 CO) – un duplicato giusta l’art. 1063 CO (Rep. 1975 pag. 101; Staehelin in: Basler Kommentar, SchKG I, 2a ed. 2010, n. 154 ad art. 82 LEF). Tale presupposto non ha tanto per scopo il controllo dell’autenticità – presunta (cfr. art. 180 cpv. 1 CPC) – del titolo (problema del resto comune a tutti i titoli di rigetto e che viene esaminato solo se viene esplicitamente sollevato dall’escusso, v. sentenza della CEF”
