If the heirs of the person presumed dead are already in possession of his or her property and an inheritance passes to him or her, his or her co-heirs may invoke this fact and request that such inheritance be released to them without need for a second declaration of presumed death.
The heirs of the person presumed dead may likewise invoke a declaration of presumed death obtained by the co-heirs.
