  1. The Federal Assembly shall exercise supervisory control over the conduct of business by the Federal Council and the Federal Administration, the federal courts, the Supervisory Authority for the Office of the Attorney General of Switzerland, the Office of the Attorney General of Switzerland and by other persons entrusted with tasks of the Confederation.1
  2. It shall exercise supervisory control over the financial budget in the context of Article 8 of the Federal Auditing Act of 28 June 19672.
  3. The Federal Assembly shall exercise supervisory control according to the following criteria:
    1. legality;
    2. regularity;
    3. expediency;
    4. effectiveness;
    5. economic efficiency.
  4. Supervisory control shall not include the power to revoke or alter decisions. It shall not include control over the content of the judicial decisions of the Office of the Attorney General of Switzerland.3

N1.Oberaufsicht ohne inhaltliche Kontrolle

Die Oberaufsicht umfasst grundsätzlich Verwaltung, äusseren Geschäftsgang und Organisationsfragen des Bundesgerichts (z. B. Finanzhaushalt, Abläufe). Die Bundesversammlung ist nicht befugt, Entscheide aufzuheben oder zu ändern; eine inhaltliche Kontrolle bundesgerichtlicher Entscheide (sowie der Entscheide der Bundesanwaltschaft) ist ausgeschlossen.

Dies ist richtigzustellen: Wie die Subkommissionen Gerichte/Bundesanwaltschaft in ihrem Nichteintretensentscheid vom 21. Dezember 2021 zuhanden des heutigen Gesuchstellers zutreffend ausführten, übt die Bundesversammlung die Oberaufsicht über das Bundesgericht aus (Art. 26 Abs. 1 des Bundesgesetzes vom 13. Dezember 2002 über die Bundesversammlung [ParlG; SR 171.10]). Dasselbe ergibt sich aus Art. 3 des Bundesgesetzes vom 17. Juni 2005 über das Bundesgericht (BGG; SR 173.110). Zum Prüfungsgegenstand der Oberaufsicht zählen namentlich die Justizverwaltung und der äussere Geschäftsgang (Finanzhaushalt, Organisation, Funktionsweise, Abläufe usw.) sowie die blosse Kenntnisnahme der Rechtsprechung (Heinrich Koller, in: Basler Kommentar, Bundesgerichtsgesetz, 3. Aufl. 2018, N. 16 zu Art. 3 BGG; Alain Wurzburger, in: Corboz et al., Commentaire de la LTF, 2. Aufl. 2014, N. 10 ff. zu Art. 3 BGG). Demgegenüber ist die Bundesversammlung weder befugt, Entscheide aufzuheben noch solche zu ändern. Die inhaltliche Kontrolle bundesgerichtlicher Entscheide durch die Bundesversammlung ist ausgeschlossen (Art. 26 Abs. 4 ParlG).
