Whether the 2011 Swiss exequatur and internment order were void for lack of an initial psychiatric expertise
The absence of a prior expertise did not create a defect serious enough to render the exequatur decision null.
Nullity is exceptional and reserved for grave, manifest defects. The internment corresponded to the foreign sanction and was based on the foreign judgment's dangerousness findings; any omission in ordering an expertise could have been challenged on ordinary appeal, and periodic review under Art. 64b CP offered sufficient protection.
