Chapter 122:33-1 Priority Investment Area Designation

Ohio Adm.Code 122:33-1-01 Designation.

(A) Subdivisions requesting designation of a site within the subdivision's territory as a priority investment area may submit this request to the department's community services division in the form and manner determined by the department.

(B) Notwithstanding paragraph (C) of this rule, requests for priority investment area designation will be reviewed, pursuant to section 122.161 of the Revised Code, in the order received by the department's community services division.

(C) The department will prioritize review of requests for priority investment area designation for those areas negatively impacted by the decline of the coal industry.

(D) The department will not approve a subdivision's request for designation of a priority investment area if the boundaries described therein exceed the subdivision's territory, as defined in division (A)(3) of section 122.161 of the Revised Code.
