3.02 Digitized Imaging

3.02: Digitized Imaging (1) Definition. “Digitized Image”, a computer generated likeness of a data subject produced by scanning either the data subject or the data subject’s photograph. (2) Imaging. A holder shall disseminate the digitized image or photograph of any data subject, including the data subject’s signature, upon request, either in writing or by electronic transmission, by any criminal justice agency as defined in M.G.L. c. 6, § 167 conducting official business. 501 CMR 3.02 (2) shall in no way limit any rights of any law enforcement or criminal justice agency to obtain any other data as provided by statute, regulation, or judicial order.
