2.05: Fees DIREC TO R'S AUTHO RITY 230 CMR 2.00 is promulgated pursuant to M.G.L. c. 13, § 9A authorizing the Director of Registration to make such rules and regulations governing the conduct of examinations by the Boards of Registration. 230 CMR 2.00 shall "standardize procedure and protect the Commonwealth and applicants for registration against fraud."

2.01 Preparation of Examinations

2.01: Preparation of Examinations The Director of Registration shall employ professional independent testing services for the preparation of licensure examinations. Unless otherwise required by law, the Boards of Registration shall be authorized to invite offers from interested testing services. The topics to be tested shall comply with applicable provisions of the law governing the particular Board. The Boards shall present all offers received to the Director ofRegistration along with their comments and recommendations. The Director shall then be authorized to enter into a contract with the professional independent testing service that most favorably meets the Director's specifications.

2.02 Administration of Examinations

2.02: Administration of Examinations The Director of Registration shall enter into a contract with a professional independent test administration service for the purposes of examination siting, pro c to ring, guaranteeing security, guaranteeing comfortable testing environments, and all other administrative duties necessary for the proper administration of examinations. The Director of Registration may enter into a contract with a professional independent testing service, discussed in 230 CMR 2.01, for the administration of the examination it prepares.

2.03 Compliance with Executive Order No. 195

2.03: Compliance with Executive Order No. 195 Each contract entered into by the Director of Registration with a professional independent testing service and a professional independent test administration service shall have the following language: "The Governor or his designee, the Secretary of Administration and Finance, and the state auditor or his designee shall have the right at reasonable times and upon reasonable notice to examine the books, records and other compilations of data of (vendor) which pertain to the performance of the provisions and requirements of (this contract or agreement)."

2.04 Applicable Law

2.04: Applicable Law All contracts entered into by the Director of Registration shall be governed by the laws of Massachusetts.

2.05 Fees

2.05: Fees Examination fees shall be paid by the examinees directly to the professional independent testing services and/or the professional independent test administration services and/or the Commonwealth of Massachusetts. Said fees shall be determined annually by the commissioner of administration under the provision of M.G.L. c. 7, § 3B. Said fees shall be nonrefundable.
