Chapter 75-1 Organization of the Board

(1) The Board is composed of five (5) members who are appointed by the Governor. The five (5) members shall be constituted as follows: three (3) members are either a board-certified behavior analyst or a board-certified behavior analyst-doctoral and who are eligible for licensure under this chapter. One (1) member who is a board-certified assistant behavior analyst who is eligible for licensure under this chapter. Such member shall apply for licensure as soon as feasible after appointment. One (1) public member who is:

(a) Not a licensed behavior analyst or a licensed assistant behavior analyst or the spouse of such person;

(b) Has never been in the practice of applied behavior analysis or the spouse of such person; and

(c) Does not have and has never had a material interest in the practice of applied behavior analysis.

(2) Members shall serve three-year terms and until their successors are duly appointed and qualified; provided, however, that initial terms shall be staggered so that one member serves an initial term of one year, two members serve initial terms of two years, and two members serve initial terms of three years, as designated by the Governor. No member shall be appointed to more than two consecutive three-year terms.

Each year the full Board shall hold at least two meetings. Additional meetings may be called by the Chairperson or may be held upon the written request of any three members of the Board. Three (3) members of the Board shall constitute a quorum. Such meetings may be conducted in-person, by telephone, by virtual means, or any combination thereof.

Chapter 75-2 Fees

Chapter 75-3 Procedural Rules

The Georgia Behavior Analyst Licensing Board hereby adopts by reference as its permanent rules Chapter 295 Joint Secretary, Professional Licensing Boards, and any future amendments thereto, of the Rules and Regulations of the Office of the Division Director, Professional Licensing Boards Division.

Chapter 75-4 Ethics Code

The Georgia Behavior Analyst Licensing Board hereby adopts by reference, as the foundation of ethical and professional behavior, the Behavior Analyst Certification Board (2020) Ethics Code for Behavior Analysts, and any future amendments thereto.

Chapter 75-5 Licensure Requirements

(1) Each person desiring to obtain a license as a Licensed Behavior Analyst (LBA) pursuant to this chapter shall submit the appropriate application to the Board, the fee (see fee schedule) and all required supporting documents. The most current versions of applications and other forms are available on the Board website.

(a) A complete application shall furnish satisfactory evidence demonstrating that the applicant:

1. Is of good moral character;

2. Conducts his or her professional activities in accordance with accepted professional and ethical standards and guidelines for responsible conduct for behavior analysts established by the Behavior Analyst Certification Board (BACB) or its successor, or another entity that conducts programs to certify professional practitioners of behavior analysis that are accredited by the National Commission on Certifying Agencies, or the American National Standards Institute as identified by the board;

3. Has received satisfactory results from a fingerprint record check report conducted by the Georgia Crime Information Center and the Federal Bureau of Investigation, as determined by the board. Application for the issuance of a license under this chapter shall constitute express consent and authorization for the board or its representative to perform a criminal background check. Each applicant who applies to the board for licensure agrees to provide the board with all information necessary to run a criminal background check, including, but not limited to, classifiable sets of fingerprints. Such applicant shall be responsible for all fees associated with the performance of such background check. (See instructions on how to register and complete the fingerprint check posted on the Board website, Application/Form Downloads link);

4. Successful passage of a behavior analyst examination conducted by the Behavior Analyst Certification Board (BACB) or its successor, or another entity that conducts programs to certify professional practitioners of behavior analysis that are accredited by the National Commission on Certifying Agencies, or the American National Standards Institute as identified by the board;

5. Conferred a master's degree based on applied behavior analysis coursework in an approved sequence;

6. Maintains active status as a board certified behavior analyst through Behavior Analyst Certification Board (BACB) or its successor, or another entity that conducts programs to certify professional practitioners of behavior analysis that are accredited by the National Commission on Certifying Agencies, or the American National Standards Institute as identified by the board;

7. Secure and Verifiable Document (i.e. Driver's license, passport, etc.) or other recognized document as listed by the Georgia Attorney General's office - listing is available: (web address); and

8. Affidavit of Citizenship (Board form in application)

(2) Each person desiring to obtain a license as a Licensed Assistant Behavior Analyst (LaBA) pursuant to this chapter shall submit the appropriate application to the Board, the fee (see fee schedule) and all required supporting documents. The most current versions of applications and other forms are available on the Board website.

1. Is of good moral character;

2. Conducts his or her professional activities in accordance with accepted professional and ethical standards and guidelines for responsible conduct for behavior analysts established by a certifying entity;

3. Has received satisfactory results from a fingerprint record check report conducted by the Georgia Crime Information Center and the Federal Bureau of Investigation, as determined by the board. 5. Hold a bachelor's degree based on applied behavior analysis coursework in an approved sequence;

6. Maintains active status as a board certified assistant behavior analyst;

7. Maintain ongoing supervision by a licensed behavior analyst in a manner consistent with the certifying entity's requirements for supervision;

8. Secure and Verifiable Document (i.e. Driver's license, passport, etc.) or other recognized document as listed by the Georgia Attorney General's office - listing is available: (web address); and

9. Affidavit of Citizenship (Board form in application).

The board shall issue a license to a person who is actively licensed as a behavior analyst in good standing in another state if such state imposes comparable licensure requirements as those imposed pursuant to this chapter and such state offers reciprocity to individuals licensed in this state. Applicants for reciprocity shall submit proof of current licensure, current certification by a certifying entity, compliance with ethical standards, and satisfactory results on a criminal background check.

Ga. Comp. R. & Regs. r. 75-5-.03 Temporary Licensure {#sec-ga.-comp.-r.-regs.-r.-75-5-.03 omnilex-key=us-ga-regs-official--department-75--Ga. Comp. R. & Regs. r. 75-5-.03}

A board certified behavior analyst or a board certified assistant behavior analyst residing and practicing in another state who temporarily provides applied behavior analysis services in this state to a resident of this state may apply for a Temporary License to practice behavior analysis in this state. Satisfactory results on a criminal background check are required. A temporary behavior analysis license may be issued only if the behavior analysis services are to be delivered during a limited and defined period of not more than a total of 30 days within a calendar year or shorter term otherwise approved by the board.
