8 CAR § 296-101 Findings {#sec-8-car-296-101 omnilex-key=us-ar-regs-official--title-8-part-296--8 CAR § 296-101}

8 CAR § 296-101. Findings.

(a) The Southeast Arkansas Regional Solid Waste Management District finds that recycling glass, plastic, cans, paper, and other materials will reduce the state’s reliance upon landfills.

(b) Additionally, other solid waste reduction activities will help reduce the state’s dependence on landfills by:

(1) Using waste items:

(A) As raw materials in a production process;

(B) To produce an end product without recycling; and

(C) As fuel; and/or

(2) Other activities as approved by the Board of Directors of the Southeast Arkansas Regional Solid Waste Management District.

(c)(1) “Solid waste reduction activities” means other activities that divert materials from landfills for reuse, including all of the above without limitation.

(2) Waste stream reduction activities also curb littering, illegal dumping, and abate the environmental risks caused by current solid waste practices.

8 CAR § 296-102. Intent.

(a) As a result of Acts 2013, No. 1333, the Southeast Arkansas Regional Solid Waste Management District is responsible for the administration and distribution of the Solid Waste Management and Recycling Fund allocated to the district per the formula outlined in Acts 2013, No. 1333.

(b) The intent of the district is to use recycling grant funds for the purpose of recycling and waste reduction activities as described herein.

(c)(1) The Board of Directors of the Southeast Arkansas Regional Solid Waste Management District shall distribute the funds allocated by the Division of Environmental Quality to the district through a grant program.

(2) The board will distribute the funds to the counties included in the district on a pro rata system based on:

(A) The population of the county; and

(B) Its percentage of the district’s total population.

8 CAR § 296-103. Eligibility.

(a) Projects eligible for grant assistance include, without limitation, costs for:

(1) Solid waste management planning that integrates recycling;

(2) Public information and education programs that encourage waste reduction and stimulate demand for products produced from recycled materials;

(3) Waste transfer facilities and equipment that integrates recycling in their operation;

(4) Recycling, recycling activities, and waste reduction activities associated with illegal dump abatement programs;

(5) Other waste stream reduction activities that divert the flow of materials away from landfills to be put to beneficial use;

(6) Activities that support a recycling system including without limitation operation, construction, logistical systems, and equipment; and

(7) Administrative costs for operation of the Southeast Arkansas Regional Solid Waste Management District recycling activities, not to exceed twenty-five percent (25%) of the district’s total allocation.

(b) The Board of Directors of the Southeast Arkansas Regional Solid Waste Management District shall be responsible for the prioritization and selection of grant recipients from within the district boundaries.

8 CAR § 296-104. Procedures.

(a)(1) Each grant recipient shall, until all grant funds are expended on a project, provide Southeast Arkansas Regional Solid Waste Management District staff with an annual report summarizing the activity of the project for that year.

(2) The annual report shall include the following:

(A) Progress in the project;

(B) An expense itemization for each grant award that lists:

(i) Each expenditure;

(ii) The date;

(iii) Item purchased; and

(iv) Price and name of vendor; and

(C) Equipment purchases, which shall also include:

(i) Copies of invoices;

(ii) Purchase orders;

(iii) Checks; and

(iv) Other supporting documentation.

(3) Supporting documentation for all other purchases should be kept on file by each grant recipient for a period of five (5) years.

(b)(1) Each grantee shall provide Recycling Activity Surveys for a period of five (5) years after a grant award to district staff due by August 1 of each year.

(2) The annual Recycling Activity Survey shall include the following information:

(A) Tonnage and type of materials collected;

(B) Revenues produced from the sale of materials collected; and

(C) Total diversion savings calculated using total tons recycled multiplied by the local landfill tipping fee.

8 CAR § 296-105. Public participation.

(a) The Southeast Arkansas Regional Solid Waste Management District shall ensure public participation and notice prior to any grant award.

(b)(1) The district shall publish a notice describing each grant request and solicit comments in a newspaper of general circulation prior to grant award.

(2) The notice shall be published one (1) time, but the comment period shall not be less than thirty (30) days from the date of publication.
