17 CAR § 271-101. Purpose.

The purpose of this part is to set specific requirements to be followed by the Arkansas Professional Bail Bond Company and Professional Bail Bondsman Licensing Board in the administration of the beginning and continuing education program, pursuant to Acts 1997, No. 909, codified as Arkansas Code § 17-19-402.

17 CAR § 271-102. Effective date and applicability.

This part shall be effective October 1, 2005, and shall be applicable to the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board and approved beginning and continuing education course providers in the administration of the beginning and continuing education program.

17 CAR § 271-103 Definitions {#sec-17-car-271-103 omnilex-key=us-ar-regs-official--title-17-part-271--17 CAR § 271-103}

17 CAR § 271-103. Definitions.

The following terms as used in this part shall have the following definitions:

(1) “Board” means the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board;

(2) “Director” means the Executive Director of the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board;

(3) “Beginning education” means a course covering the Arkansas Code and rules related to the bail bond industry and taken prior to licensing;

(4) “Continuing education” means postlicensure education derived from participation in courses in bail bond related subjects;

(5) “CEC” means continuing education credit;

(6) “Credit hour” mean an instructional classroom session of at least fifty (50) minutes with a Professional Bail Bond Company and Professional Bail Bondsman Licensing Board-approved instructor present;

(7) “Instructor” means a person registered and approved by the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board to teach bail bond related subjects;

(8) “Licensee” means a natural person who is licensed by the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board as a bail bondsman; and

(9) “Proof of completion” means the certificate of attendance awarded by the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board-approved instructor.

17 CAR § 271-104. Application for course approval.

(a)(1) All proposed beginning and continuing education course outlines must be submitted to the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board for review.

(2) No course shall be certified until approved by the board.

(b)(1) Approval of courses shall be required annually.

(2) Course providers desiring approval for the upcoming year shall submit the proposed course outlines by November 1 to be considered and approved at the December board meeting.

(c)(1) A bail bond company shall be allowed to offer qualifying continuing education courses if:

(A) The course has been approved by the board; and

(B) The classes are attended by and monitored by a board-approved course provider other than the company course provider who certifies the bail bondsmen have completed six (6) hours of continuing education as approved by the board.

(2) All approved classes must be offered at a neutral location.

(3) Classes conducted on the premises of any bail bond company will not be approved.

(4) Any continuing education course offered by a bail bond company must be open to attendance by bail bondsmen from other companies at the same cost paid by bail bondsmen from the presenting company.

(d) Education providers must notify the board office, in writing, of the date, time, and location of beginning or continuing education classes two (2) weeks prior to the class being offered.

17 CAR § 271-105. Approval or denial of course.

(a) Properly completed course outlines will be submitted for consideration by the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board.

(b) The board will review the proposed course outlines. Final approval of course outlines shall be the responsibility of the board.

17 CAR § 271-106 Approval of fee for beginning and continuing education classes {#sec-17-car-271-106 omnilex-key=us-ar-regs-official--title-17-part-271--17 CAR § 271-106}

17 CAR § 271-106. Approval of fee for beginning and continuing education classes.

(a) Proposed course outlines shall include a schedule of fees applicable to said classes.

(b) Such schedule of fees shall be subject to the approval of the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board.

17 CAR § 271-107. Certificate of completion.

(a) At the completion of each class, an attendance list shall be provided to the Professional Bail Bond Company and Professional Bail Bondsman Licensing Board within two (2) weeks of course completion.

(b) At the completion of each class, students who satisfactorily complete a course shall be awarded a certificate of attendance containing the following information:

(1) Name of school or sponsor;

(2) Name of student (applicant or licensee);

(3) License number, if licensed;

(4) Course title;

(5) Course location;

(6) Course date and dates;

(7) Number of classroom hours of instruction; and

(8) Instructor’s signature.

17 CAR § 271-108. Severability.

Any section or provision of this part held by the court to be invalid or unconstitutional will not affect the validity of any other section or provision.
