Ala. Admin. Code r. 770-X-11-.01 Scope And Definition

These Rules and Regulations shall govern every person who operates, as a common carrier or for hire, any pipeline for the transportation of oil, gas or other commodity in intrastate commerce in Alabama (Such persons are called “pipeline carriers” in these Rules and Regulations).

Ala. Admin. Code r. 770-X-11-.02 Safety

Pipeline carriers of hazardous materials shall comply with the relevant safety standards adopted by the United States Department of Transportation; in addition, compliance is required notwithstanding U.S. Department of Transportation exemptions for gathering lines.

Ala. Admin. Code r. 770-X-11-.03 Metering

(1) Appropriate meters or other appropriate measuring devices shall be installed to show the quantity of product put into the pipeline, and the quantity of product removed from the system in the normal course of business.

(2) Appropriate documents showing meter readings or other measurements shall be prepared and shall be retained for at least 24 months.

Ala. Admin. Code r. 770-X-11-.04 Tariffs And Contracts

Each pipeline carrier shall have on file with the Commission a tariff containing its rates, charges and rules for transportation and any related service; provided, however, that the rates and charges may be contained in contracts, but only if the contract or a complete copy has been filed with and approved by the Commission.

Ala. Admin. Code r. 770-X-11-.05 Reports

(1) Annual Reports – Each pipeline carrier shall file with the Commission, within 90 days after the close of its fiscal year, its annual report on forms supplied by the Commission, provided, however, that:

(a) The carrier’s Alabama intrastate transportation revenue shall be shown as a separate item.

(b) If the carrier’s fiscal year does not end on December 31, the transportation revenue shall be shown for each month.

(2) Special Reports – If a pipeline carrier is sold or if a controlling interest in a pipeline carrier is sold, a special report shall be filed with the Commission within 60 days after the transaction. This report shall provide a description of the transaction, the identity of the new owner(s), and any changes in the carrier’s location or address.

Ala. Admin. Code r. 770-X-11-.06 Inspection And Supervision Fees

Each pipeline carrier shall pay to the Commission the inspection and supervision fees required by law. These fees shall be paid on all Alabama intrastate transportation revenue, including the Alabama intrastate transportation revenue of interstate pipelines.
