535 Alabama Manufactured Housing Commission

Ala. Admin. Code r. 535-X-17-.01 Purpose

The purpose of this rule is to ensure that manufacturers and retailers (dealers) are licensed to sell manufactured (mobile) homes or manufactured buildings (modulars) in this state in accordance with Sections 24-5-6, 24-5-10, and 24-6-4 of the Code of Ala. 1975.

Ala. Admin. Code r. 535-X-17-.02 Definitions

As used in this regulation the Commission hereby adopts and incorporates by reference thereto the definitions in the Code of Ala. 1975, Section 24-5-2(5)(6).

Ala. Admin. Code r. 535-X-17-.03 Licensing

(a) Any manufacturer or retailer (dealer) within or without this state shall apply for a license annually to sellmanufactured (mobile) homes and/or manufactured buildings (modulars) to be shipped into or sited in Alabama. This also applies to anyone who rebuilds or sells rebuilt units. In addition, all manufacturers located in Alabama must be licensed with the Alabama Manufactured Housing Commission regardless of the intended destination of their homes or buildings.

(b) Applications will be obtained from and submitted to the Commission.

(c) The license shall be valid from January 1 until December 31 of the year in which the license was issued or until revoked as provided in Section 24-5-6 of the Code of Ala. 1975.

Ala. Admin. Code r. 535-X-17-.04 Administrative Costs

License fees shall be established or revised in accordance with Sections 24-6-4, 24-5-6, and 24-5-10 of the Code of Ala. 1975 and Chapter 535-X-16 of the Commission Rules and Regulations.

Ala. Admin. Code r. 535-X-17-.05 Reporting Requirements

All manufacturers and retailers shall complete a monthly sales report on a form provided by the Commission and file it with the Commission no later than the tenth day of the month denoting the previous month’s sales. Retailers must provide a new and a used sales report.
