By order of March 6, 2026, the plaintiff was directed to answer the application for
leave to appeal the December 19, 2025 order of the Court of Appeals. On order of the
Court, the answer having been received, the application for leave to appeal is again
considered. Pursuant to MCR 7.305(I)(1), in lieu of granting leave to appeal, we VACATE
the order of the Court of Appeals granting the plaintiff’s motion to stay further proceedings
in the trial court and granting the motion to waive the requirements of MCR 7.209(A).
Pursuant to MCR 7.209(A)(2), a motion for bond or for a stay pending appeal may not be
filed in the Court of Appeals unless such a motion was decided by the trial court. In its
motion to waive the requirements of MCR 7.209(A), the plaintiff only requested a waiver
of the requirement to provide a copy of the transcript. The plaintiff did not request a waiver
of the requirement to provide a copy of the trial court’s opinion and order. The defendant
is permitted to file a motion for bond pending appeal in the Wayne Circuit Court and the
circuit court has the authority to hear that motion.
We do not retain jurisdiction.
