Plaintiff-appellant’s motion for leave to file additional pages for response to motion for
damages is GRANTED and the additional pages filed with the motion are accepted.
Defendant-appellee’s motion for sanctions pursuant to MCR 7.216(C)(1) is GRANTED.
This case is REMANDED to the trial court for a determination of actual damages under MCR 7.216(C)(2).
The trial court shall hear and decide the matter on the record and shall enter a judgment in
appellee’s favor in the amount of actual damages. Further punitive damages are not to be assessed. We
do not retain jurisdiction.
