The motion to dismiss pursuant to MCR 7.211(C)(2)(a) is DENIED. Under the
circumstances, the claim of appeal filed on September 24, 2025, is treated as both a claim of appeal from
the order entered on September 3, 2025, and an application for leave to appeal from the order entered on
July 28, 2025, and leave to appeal from the July 28, 2025 order is GRANTED. The appeal may proceed
on the appellant brief as filed. The time for filing appellee’s brief under MCR 7.212(A)(2)(a)(ii) shall be
calculated from the date this order is entered.
