IN THE COURT OF APPEALS
In re Conservatorship of Charlene A. Nutton
Court of Appeals Nos. 379174 / 379634 (Consolidated)
Lower Court No. 2025-425698-CA
Oakland County Probate Court, Hon. Traci Richards
APPELLANT’S NOTICE OF COMPLIANCE WITH FEBRUARY 17, 2026 DEFECT LETTER
AND WITHDRAWAL OF PENDING EXTENSION REQUEST
TO: Michigan Court of Appeals, Office of the Clerk
FROM: Susan R. Carré, Appellant, Pro Se
DATE: March 10, 2026
I. NOTICE OF COMPLIANCE — DEFECT CURED
On February 17, 2026, the Court issued a defect letter advising Appellant that the appeal
had not been perfected due to the absence of a stenographer’s certificate, and that the
matter was eligible for involuntary dismissal under MCR 7.217 if the defect was not cured
within 21 days. The 21-day deadline falls on March 10, 2026.
Appellant hereby notifies the Court that the defect has been cured. On the evening of
March 10, 2026, Phoenix Court Reporting completed production of all three transcripts
and her certificate of filing, and transmitted the following notice to Appellant:
“The transcript as well as my certificate of filing has been completed and forwarded to
Circuit Court. Not sure what you need to do, however you can contact the Court. Thank
you again.”
The stenographer’s certificate has been filed with the Oakland County Circuit Court. The
following transcripts have been produced and delivered:
1. January 14, 2026 hearing — conservatorship petition, stay denial, and protective
order (12 pages, including cover and certification)

2. May 23, 2025 hearing — denial of Appellant’s petitions (combined 48 pages)
3. May 16, 2025 hearing — emergency guardianship and conservatorship petitions
The defect identified in the February 17, 2026 letter has been fully cured within the
21-day deadline. Appellant respectfully requests that the default status be cleared and
that no costs be assessed.
II. WITHDRAWAL OF PENDING MOTION TO EXTEND DEADLINE
Appellant previously filed a Motion to Extend the deadline to cure the transcript defect,
which remains pending before this Court. Because the defect has now been cured within
the original 21-day deadline, the extension motion is no longer necessary. Appellant
hereby withdraws the pending motion to extend.
III. DILIGENCE
Appellant notes for the record that she pursued the transcripts under financial hardship
and pursuant to MCR 2.002, the fee waiver mechanism that became effective January 1,
2025. Appellant contacted Phoenix Court Reporting directly, coordinated production on
an expedited basis, and documented her pursuit of the transcripts in a Diligence Notice
filed with this Court on March 9, 2026. The transcripts were produced and the certificate
filed on the evening of March 10, 2026 — the last day of the 21-day cure period.
IV. RELIEF REQUESTED
Appellant respectfully requests that this Court:
1. Acknowledge receipt of this notice and confirm that the stenographer’s certificate
defect has been cured;
2. Clear the default status and remove the matter from eligibility for involuntary
dismissal under MCR 7.217;
3. Assess no costs, as the defect was cured within the 21-day deadline; and
4. Deem the pending Motion to Extend withdrawn as moot.
