KADI A KAMENDAT V JACOB T MORSE
Docket No. 380684
LC No. 17-029669-DM

Judges
Pursuant to MCR 7.211(C)(4) and MCR 7.205(E)(2), and in lieu of granting the application
for leave to appeal, we PEREMPTORILY REVERSE the April 21, 2026 contempt order in part and
VACATE the order to the extent that it imposed an unavoidable, 13-day jail sentence. Because defendant
was deprived of the “keys to his prison” and was unable to purge the contempt sentence by complying
with the court’s prior order as to that 13-day sentence, the 13-day sentence could not be imposed as civil
contempt. In re Moroun, 295 Mich App 312, 339-340; 814 NW2d 319 (2012) (citation and quotation
marks omitted). In all other respects, including as to the remaining portion of the trial court’s contempt
order that conditioned confinement on compliance with court orders, leave to appeal is DENIED for lack
of merit in the grounds presented.
The motion for immediate consideration of the motion for stay is GRANTED, and the
motion for stay is DENIED as moot in light of the outcome of the application.
The motion to waive the requirements of MCR 7.209 is GRANTED.
