Court of Appeals, State of Michigan
ORDER
PEOPLE OF MI V COLE STEVEN GILDE
Docket No. 376429
LC No. 13-002602-FC
James Robert Redford
Presiding Judge
Randy J. Wallace
Christopher M. Trebilcock
Judges
The motion to waive fees is GRANTED for this case only.
The application for leave to appeal is DENIED for lack of merit in the grounds presented.
_______________________________
Presiding Judge
Wallace, J., concurs with the decision to deny the application for leave to appeal for lack of merit on the
grounds presented. I write separately to note that defendant’s filing in the trial court does not constitute a
motion filed under subchapter 6.500, because defendant did not request relief under that subchapter.
Rather, he requested appointment of an attorney who could file such a motion on his behalf. Because
defendant did not provide the trial court with any authority permitting it to appoint counsel in such a
circumstance, I concur that the application for leave to appeal the order of the trial court, which denied
defendant’s request, should be denied.
