Court of Appeals, State of Michigan
ORDER
JOSEPH S DULAK V MENOMINEE COUNTY ELECTION
COMMISSION
Docket No. 377540
LC No. 25-018006-AA
Philip P. Mariani
Presiding Judge

Judges
On the Court’s own motion, plaintiff-appellant shall file a supplemental brief within 21
days after the date of this order addressing whether this appeal should be dismissed because it has become
moot. See https://www.ehextra.com/news/joe-dulak-recall-effort-fails/article_f246ddc0-d0c9-4581-
884c-a363f2debca3.html (accessed February 11, 2026) (media article indicating recall effort against
plaintiff-appellant failed due to not collecting enough valid signatures). The supplemental brief shall
specifically address whether the appeal has become moot because the 180-day period during which the
recall petition at issue was valid for circulation under MCL 168.952(8) has expired without sufficient valid
signatures being collected. This shall include consideration of whether such a 180-day period began to
run on August 11, 2025, i.e., 40 days after the appeal to the circuit court was filed in this matter, so that
the 180-day period expired on February 9, 2026.
Alternatively, if plaintiff-appellant no longer wishes to pursue this appeal because he now
believes it is moot (or otherwise no longer wishes to pursue the appeal), he may file a motion to withdraw
the appeal within 21 days after the date of this order.
