The motion to dismiss the Hamtramck City Clerk as a party defendant is DENIED. The
former City Clerk is not a party; the Office of City Clerk is the party defendant and remains the party
defendant despite the former Clerk’s having vacated the office. See Mays v Snyder, 323 Mich App 1, 88;
916 NW2d 227 (2018) and MCR 2.202(C). Note too that the Court’s order setting the time for appellee
briefs to be filed should not be construed as ordering the Office of City Clerk to file an appellee brief.
