Notice of Withdrawal of Motions for Stay of Trial Court
Proceedings and to Waive the Requirements of MCR 7.209(A)
RECEIVED by MCOA 6/17/2026 10:06:54 AM
-- 1 of 6 --
On May 5, 2026, the appellants filed (1) a motion under MCR 7.209(D) asking
this Court to stay the proceedings in the trial court pending resolution of their
application for leave to appeal and (2) a motion to waive the requirements of MCR
7.209(A)(2) and (3) in connection with their motion to stay. Because the trial court
was unavailable to hear a motion to stay before the appellants’ answer was due in
the trial court, the appellants filed their motion to stay in this Court at the same
time that it filed its motion in the trial court.
On June 12, 2026, the trial court entered an order granting the appellants’
motion to stay pending resolution of this appeal. (Exhibit 1). The motion to stay
and the motion to waive the requirements of MCR 7.209(A) that the appellants filed
in this Court are therefore moot.
The appellants hereby withdraw both (1) their May 5, 2026 motion to stay
and (2) their May 5, 2026 motion to waive the requirements of MCR 7.209(A)(2) and
(3) as moot. The application for leave was fully briefed on May 26, 2026 and remains
pending.
