Docket No. 381308
LC No. 2025-219646-CZ

The motion for immediate consideration is GRANTED.
Pursuant to MCR 7.205(E)(2), in lieu of granting the application for leave to appeal, the
Court VACATES the May 29, 2026 order disqualifying defendants’ attorney and REMANDS for
reconsideration. The trial court erred by disqualifying Tishkoff PLC without determining whether
attorney William Tishkoff received information from plaintiff that could be “significantly harmful” to
plaintiff in this matter. See MRPC 1.18(c). Plaintiff and Tishkoff provided conflicting accounts of their
prospective-client conversation, creating a factual question regarding what occurred during that meeting
and whether plaintiff provided information that could be significantly harmful to him. Absent factual
findings by the trial court, the record is inadequate for this Court’s review. See In re Martin, 200 Mich
App 703, 717; 504 NW2d 917 (1993). On remand, the trial court shall determine whether plaintiff
provided Tishkoff with significantly harmful information and whether disqualification is warranted under
MRPC 1.18(c).
This order is to have immediate effect. MCR 7.215(F)(2).
We do not retain jurisdiction.
