The prosecutor’s confession of error pursuant to MCR 7.211(C)(7) is APPROVED because
defendant was denied a fair trial on the basis of the trial court’s failure to comply with MCR 6.005(D),
the trial court’s failure to appoint stand-by counsel and the lack of counsel during portions of the trial, and
defendant’s removal from the courtroom in handcuffs in front of the jury after the trial court referred to
defendant being taken to jail.
This matter is REMANDED to the trial court for a new trial.
This Court does not retain jurisdiction.
