Court of Appeals, State of Michigan
ORDER
In re Duneske
Docket No. 378885
LC No. 26-000000
Michael F. Gadola, Chief Judge, acting under MCR 7.203(F)(1), orders:
The complaint for superintending control and all motions are DISMISSED for lack of
jurisdiction. Pursuant to MCR 7.203(C)(1), this Court has jurisdiction to entertain a complaint seeking a
writ of superintending control over “a lower court or tribunal immediately below it arising out of an action
or proceeding which, when concluded, would result in an order appealable to the Court of Appeals[.]”
(Emphasis added.) The 36th District Court is not a court immediately below this Court, nor would an order
concluding proceedings in that Court be appealable directly to this Court. As such, this Court lacks
jurisdiction over this complaint.
