Pursuant to MCR 7.205(E)(2), in lieu of granting the delayed application for leave to appeal,
we VACATE the trial court’s September 19, 2025 order and REMAND this matter to that court for further
proceedings consistent with this order. In ruling as it did here, the trial court erred by treating defendant’s
amended motion for relief from judgment as a successive motion for relief from judgment subject to the
procedural hurdle of MCR 6.502(G)(2). On remand, the trial court should reconsider the motion on the
merits without applying MCR 6.502(G).
This order is to have immediate effect. MCR 7.215(F)(2). We do not retain jurisdiction.
