The motion for immediate consideration is GRANTED.
The motion for stay pending appeal is DENIED.
The motion to seal Exhibit F is GRANTED. This Court finds good cause to seal Exhibit F
based on medical privilege and determines there are no less restrictive means to adequately and effectively
protect the interest asserted. MCR 7.211(C)(9)(e). The Clerk shall disclose or provide copies of any order
or opinion entered in this appeal, MCR 8.119(I)(5); MCR 7.211(C)(9)(c), but sealed pleadings or other
contents of the file shall not be disclosed or made available for public viewing. The Clerk is directed to
forward a copy of this order to the Clerk of the Supreme Court and to the State Court Administrative
Office. MCR 8.119(I)(7); MCR 7.211(C)(9)(c).
Pursuant to MCR 7.205(E)(2) and MCR 7.216(A)(7), and in lieu of granting the application
for leave to appeal, the March 18, 2026 order granting the People’s “motion to exclude defendant’s
insanity defense notice” is VACATED and the case is REMANDED to the trial court for reconsideration
of that motion. The trial court had the discretion to allow late amendment of the notice. See People v
Stinson, 113 Mich App 719, 723-726 (1982); People v Coulter, 94 Mich App 531, 534-535 (1980). The
trial court, therefore, erred when it determined that it did not have the discretion to allow late amendment.
People v Merritt, 396 Mich 67, 80 (1976). In all other respects, the application for leave to appeal is
DENIED for failure to persuade of the need for immediate appellate review.
We do not retain jurisdiction.
