Pursuant to MCR 7.205(E)(2), in lieu of granting the delayed application for leave to appeal,
we VACATE the trial court’s November 25, 2025 order and REMAND this matter for further proceedings
consistent with both this order and this Court’s previous order in Godell v Godell, unpublished order of the
Court of Appeals, entered September 5, 2025 (Docket No. 375626) (Godell I). By failing to strictly comply
with this Court’s remand instructions in Godell I, the trial court violated the rule of mandate. See Great
Lakes Eye Institute, PC v Krebs, 516 Mich 933 (2025). Specifically, the trial court failed to comply with
this Court’s prior instructions that, on remand, it was to “make findings of fact on all of the pertinent factors,
including findings explaining if and why the court finds some of the factors irrelevant as applied here.”
Godell I, unpub order at 1 (emphasis added).
This order is to have immediate effect. MCR 7.215(F)(2). We do not retain jurisdiction.
