Appellee’s motion for sanctions pursuant to MCR 7.211(C)(8) and MCR 7.216(C) is
GRANTED. This case is REMANDED to the trial court for a determination of actual damages under
MCR 7.216(C)(2).
The trial court shall hear and decide the matter on the record and shall enter a judgment
in appellee’s favor in the amount of actual damages. Further punitive damages are not to be assessed. We
do not retain jurisdiction.
