Court of Appeals, State of Michigan
ORDER
MACOMB INTERMEDIATE SCHOOL DISTRICT V STATE OF
MICHIGAN
Docket No. 378748
LC No. 25-000175-MZ
Daniel S. Korobkin
Presiding Judge
Adrienne N. Young
Mariam Saad Bazzi
Judges
The motion for immediate consideration is GRANTED.
The emergency motion for order to show cause why defendants-appellees should not be
held in contempt for violating a court order is DENIED because the assertedly contemptuous conduct
involves alleged violation of a trial court order. Any contempt in that regard would be against the trial
court, not this Court. This order is without prejudice to plaintiffs-appellants filing a motion in the trial
court to seek relief for the alleged contemptuous conduct. We note that, while MCR 7.208(A) generally
bars a trial court from setting aside or amending the judgment or order appealed from after a claim of
appeal is filed, we are aware of no authority that would preclude the trial court from granting (or denying)
a motion seeking to hold a party in contempt for alleged violation of a trial court order while this appeal
is pending.
