UNITED STATES DISTRICT COURT SOUTHERN DISTRICT OF TEXAS HOUSTON DIVISION August Wakat, et al., § Plaintiffs, § § v. § Civil Action H-25-3200 § Trisha Shafer, et al., § Defendants. § MEMORANDUM AND RECOMMENDATION This case has been referred to the undersigned magistrate judge to conduct the conference under Federal Rule of Civil Procedure 16. The court sua sponte recommends this case be DISMISSED for failure to serve the defendants. Plaintiffs August Wakat and Estella Wakat-Aikins filed their complaint on July 3, 2025. ECF No. 1. The “Proof of Noticing,” ECF No. 14, from the clerk’s internal noticing system, shows that the order was mailed to the Plaintiffs at the addresses listed on the docket sheet. Plaintiffs failed to complete service and did not appear at the December 5 conference. Under Federal Rule of Civil Procedure 4(m), If a defendant is not served within 90 days after the complaint is filed, the court—on motion or on its own after notice to the plaintiff—must dismiss the action without prejudice against that defendant or order that service be made within a specified time.
