Case No. S-R-114; M-511
PERB Order No. Ad-121
Administrative Appeal
December 22, 1981
Appearances: Gene Bell (Becker & Bell, Inc.), Representative
for Placerville Union School District.
Before Gluck, Chairperson; Moore, Tovar and Jaeger, Members.
DECISION
This case is before the Public Employment Relations Board
(hereafter Board) on an appeal by the Placerville Union School
District (hereafter District) to the attached determination by
the regional director of the Board's Sacramento Regional Office
that impasse existed between the District and the Placerville
Elementary Educators Association, CTA/NEA (hereafter
Association).
FACTS
On October 26, 1981,1 the Association requested that the
regional director declare impasse. On November 3, the regional

director declared that impasse existed. The District appealed
that determination on November 11. Thereafter, on November 19,
the District, by letter, informed the regional director that
the parties were in agreement that, as of November 16, an
impasse did in fact exist and requested the appointment of a
mediator. By that same letter, the District stated that it was
not abandoning the instant appeal .
.The parties currently agree that an impasse existed as of
November 16. There are no other matters before the Board·
relating to negotiations between the parties. The District
offers no reason why a determination of the original appeal is
necessary. Thus, we find that the issue as to whether impasse
existed on November 3 is moot and that it is not necessary to
address the issue raised by the District's appeal.
OOWR
For the reasons set forth in the foregoing Decision, the
Board hereby DISMISSES the instant appeal.
